The Future of AI Regulation

We are just in the first inning of AI law. The EU AI Act was the beginning, not the end. Here is what's coming next.

1. Global Convergence

Currently, we have a patchwork of laws (EU vs. US vs. China). We predict a convergence towards the "Brussels Effect," where multinational companies adopt the strictest standard (EU) globally to simplify compliance.

2. Liability Shift

Right now, software is mostly "use at your own risk." We expect new laws to shift liability onto the developers of high-risk AI models. If a model causes harm, the creator will pay.

3. Specialized AI Agencies

Existing regulators (FTC, SEC) are overwhelmed. We predict the creation of dedicated "AI Safety Agencies" in major economies, staffed by technical experts who can audit code and weights.

4. Mandatory Watermarking

As deepfakes threaten elections and trust, governments will mandate invisible, cryptographic watermarking for all AI-generated content.

2026 Prediction

The first major class-action lawsuit against a GenAI company for "negligent training" will reach the Supreme Court.
